Richtlijn 98/59/EG collectief ontslag

De richtlijn verplicht werkgevers die collectief ontslag overwegen tot tijdige raadpleging van werknemersvertegenwoordigers en melding aan de bevoegde overheidsinstantie. In Nederland is zij geïmplementeerd in de Wet melding collectief ontslag.
Key point: Uitleg van de WMCO, waaronder het begrip 'ontslag' en de raadplegingsplicht, gebeurt in het licht van deze richtlijn en de rechtspraak van het HvJ EU.
